The Commission apiKimtcd to inquire into the Pacific railroad matters met In this city this morning. Tlioro wore also present ex-Judge Dillon, counsel for tho Commission, and A. A. Cohen, counsel for tbe Central tk Southern Pucific railroad. Mr.

Crookor was the first witness culled. He wont into a detailed account of a toehmeal character us to the niuinior in which the roud was built. The books kept consisted of ordinary cash books, blotters and ledgers. Ho bad no idoa of where theso books wore now and did not think it mutoriul to anybody anyhow and If any person did ask to soo them ho would toll thorn It was uouo of his business. Mr.

Anderson remarked Wall I will tuko the liberty of asking you whut became of tho books!" Crocker unswored: My dear sir, I have no moro idea of where thoy are than the man in the moon. 1 guess I have not aeon thorn since 1809." On cross-oxuminution the witness admitted that the majority of tho railway stock at that early date wus reully banded over to tbe Contract and Finance Company. The company did not pay up to $1,700 share to quiet this disturbance.

Crocker talked glibly about tho wholo mutter; bow be pluyed with millions of his own money, but generally managed to come out ahead in all bis business ventures. In reply to a question as to where the books of tbe Contract und Finance Coinpaoy were, he said: Keully I do not know whore they are. 1 tried to find them for my own use some tiino ago, but was unable to discover tbolr wlioroubouts. 1 had $13,000,000 of stock when I went to Europe, but I dont know what any ono else may have been worth.

Well, we want to koow bow much you mado on thut Southern Pacific contract, remarked Mr. Anderson. In reply to another question Crocker said with emphasis: I never voted for a contract while I was a director of the Southern Paeiflo railway." A discussion arose relative to the difference between Crockers statements and tbe books of tbe company, when ho said: I wish to say right here now that, with my physically impaired memory, I dont think it fuir to be examining me against the books of the company, which are and must bo right. I am ashamed of nothing 1 have done. I have workod hard during the beat days of my life and am glad that I have worked successfully.

Every public enterprise I put my hand to turned out well for the public in general and for me in particular. Being asked if be could, in a business-like manner, tell how the money question at issue could be settled with the Government, Crocker replied that an explicit ifhswer would require more considcralion than he hud given to the subject. But I think, he added, that a conference between a committee from the board of directors and your Commission would bring about a more speedy and satisfactory result than a promiscuous Investigation like this. I know I huve never misappropriated money, and I believe that none of my colleagues ever did." When the Colton letters, which created so much discussion at the Ban Francisco session, were introduced, Mr. Crocker took them, scanned them and then said: I dont remember thorn, but they sound very much like me." When Mr.

Anderson had got through, Mr. Littlo asked what was the ability of the company to pay its debt to the Government to-day, and received: "None whatever, as tbe emphatic answer. Crocker said the company intended to pay some day, but to do it at present would ruin tho proporty. "I would suggest, he remarked, that the Government, to which money is just now no object, might give the road say a hundred or a hundred and fifty years which to pay its debt." Later he said that if the Government had given the Central Pacifio the contracts promised, the company would have nearly paid its debt by this time. Politics, insisted tho witness, are at the root of all this trouble.

When the road is nut of politics it will prosper." In reply to another question, he said that there was never a penny in stock, bond or money offered to any legislator to secure corrupt influence. Mr. Cohen then began to cross-examine the witness and elicited the statements that the road was completed seven years ahead of contract time at the expense of millions of dollars; that the Government had not kept the promises made to tho company in the act of 1862, but had given its contracts to other parties. It was alleged that the Government had saved some $139,600,000 by the road, yet would not give it enough patronage to enable it to pay its dobt, which could easily have been done. The company had faithfully fulfilled all its contracts and he had asked the board of directors to introduce a bill in Congress claiming payment in compensation for contracts made with the company but never fulfilled.

This concluded the testimony and the Commission adjourned. Drs. M. H. Brandom.
