Smith has this day commenced an action in the District Court sitting in and for the Connty of Shawnee, Kansas Territory, a-gainst W. W. Griswold, defendant. And whereas by the affidavit of Jacob Salford, the plaintiffs attorney in this case, filed herein, it appeals that the said W. W.

Griswold, deft. is a non resident of the territory of Kansas, and cannot therefore be pe'sonally served with process issuing out of this Court. It is therefore ordered by the clerk of said Court in vacation, that publication be made for six successive weeks in a newspaper publL-hed in said county of Shawnee notifying the said deft W. W. Griswold of the pending of the above entitled suit, the object of which appears from the Petition of said plaintiff, this day filed setting forth that the said W.

W. Griswold was indebted to the said plaintiff in the sum of two hundred and sixty dollars with interest thereon since the 1st of June, 1859, and that the said W. W. Griswold gave a mortgage to the said E. M.

Smith, on the south west quarter of section number 31, in township number 12 of range number 16, section 3, containing one hundred and sixty acres more or less, situate in said county of Shawnee, to recover the payment of the said sum of two hundred and sixty dollars accordiug to the conditions of certain note, referred to in the said mortgage, and praying judgment against the said W. Griswold for the said sum now claimed to be due, amounting to two hundred and sixty dollars, with interest from the 1st day of June, 1859. And that said premises may be ordered to be apprai-ed and sold to pay ths same. And the said W. W.

Griswold is notified that he is required to appear and answer said petition, within twenty days after the 22d day of September next, or "it will be taken as true and judgment rendered thereon. Witness my hand and the seal of said Court, affixed at my office in the city of Topeka, this 15th day of August, A. D. 1859. A.

IV would not be surprised to learn that he has fallen in love with some virtuous man, and intends supporting him as the Independent Candidate for Delegate to Congress.

'April 14, Legal Notice. Samuel Hollander vs Lipman Levey. Lipman Levey of the State of Ohio will take notice that Samuel Hollander of Hamilton in the State of Ohio, did, on the 16th day of August, A. D. 1859, file his petition in the Clerks office of the District Court for Shawnee county, 2d Judicial District of the territory of Kansas, against said Lipman Levey, deft, setting forth that said deft is indebted to said plff in the sum of $1013,00 with interest thereon from the 7th day of 1857, it being for money due on a Due Bill made by said deft at the date last above mentioned to Hannah Rice and assigned by her to plff, and that said deft is requested to appear and answer said petition on or before the 19th day of 1859.
