G. Jones," Allen county. OPINION BY THE COUT HORTON, C. 3. This case was originally commenced before a Justice of the Peace, under section 253 of the Crimes act, G.

373, against the John, Campbell, and two others. The said A.G. Jones was the prosecuting witness. The case was tried before the Jttstice and laving been convicted the defendant Campbell gave bond and took an appeal to the 'District Court where, after several continuances, the case was called for trial at the July term, 1877, of the District Court of Allen county, Campbell announced himself ready for trial. The County Attorney having been of counsel for the defendant Campbell, the Court appointed one C.

Murray to prosecute on behalf of the State, who, with the consent of the prosecuting wit ness, A. G. and by. leave of the Court, entered a nolU prosequi oyer" the objections of the defendant Joha Campbell, and the said Campbell was discharged. Thereupon the County Attorney filed a motion in said cause to tax costs in said action to the said prosecuting witness, A.

Jones, for the following reasons: 1st.
