An appeal was at once taken to the snprema court. case of Guiin of Parsons, who was arret led for contempt in refusing to appear before tl.e Santa Fe R. R. House, as a witness in the contest, is now before the Supreme Court on a writ of habeas corpus. This case involves the question as to whether or not the body of men which broke down he floors of the capitol with sledge hammers, and rebelled against the powers that be, is the legally organized house of Ilepre-senatives.

The Populists claim that the provision of the Constitutions which declares that eneh House shall be tiie sole judge of the election and qualification of its members, takes the matter entirely out of the jurisdiction of the Courts.
