This easo stands on demurrer of l'ltft to Dcft's. answer Tins demurrer of course admits the truth of the fncU slated in that answer, and leaves merely the onu question to be decided whether that answer stiitcs valid defense to plaintiff's action. If that answer bo true, it must be admitted that the bond, the coupons of which are in controversy, were conceived in fraud and brought forth in iniquity. That they were issued on territory that at the said time had neither inhabitants or property. That said territory was nominally organized by parties in a conspiracy to issue these sell them and divide tho proceeds.

That the petition for such municipal organization, was forgery. That the election, at which the bonds wre voted, was fraudulent, the voters being carried from Reno county to Kingman and returned, without any residence whatever, in Iviugmsn. That 27 out of the 31 votes oust werf of this character. Under these circumstances, the court will not be troubled by any questions of justice nnd equity in behalf of the phtintill'. If he must have his pound of flesh, it must be because it is so nominated in tho bond, aud not because the people who are now resident: of Kingman county ought to give it.

The defendant's answer was not verified. Verification was waived by the plaintiff, so that even if requisite, no point can be raised in reference to it. IK BEIIAIjK of defendants, we-claim That, the act of the legislature (eh laws of 1873) was clearly unconstitutional so far as it authorized unorganized counties to be organized into municipal townships of the. counties, to which they arc attached for judicial purposes, under Sec. 16, Article 2, of Hie constitution ot the) state which provides "No bill shall contain more than one subject, which shall be clear ly expressed in its title." The title to said statute is as follows: "An act to amend sections 13,25, 31 52, 57, 66 and 73, of chapter 21 of the general statutes of Kansas, and providing for the enforcement of the laws and the preservation of the peace in unorganized counties ot the state of Kansas." Section 31 of said act, provides for the organization of such unorganized counties, into municipal townships of the county to which they are attached for judicial mirposes, aud further provides, "and such municipal townships, created under this act, shall have power to issue township bonds to the amount of ten thousand dollars, TO 15E CONTINUED.

Five cow-boys with (Spencers, have defied the city authorities here and a regular battle has hem held this afternoon, Mike Meagher, mayor of the city, and Oeorge a gambler, we.re killed. The cow-boys lett for the Territory, and citizens in hot pursuit. II. S. BlCKKOKD.

LATER NEWS. Full particulars cannot bo learned, in llio general excitement prevailing, even at this hour. It spems that last night and this uiornin'g a party of cow-boys, named Sherman Alias Talbot, Jim Morton, Robert Mersing and it fellow named Lowe, were drink nig and carousing. About eight o'clock this morning they began to show a disposition to raise a row, and as a preliminary move (Jcorgc Speer shot oil' his revolver into the sidewalk, on Main street. Through the efforts of the police the disturbance was suppressed, and as a precaution ADDITION A Ji I'OLICKM were put oh, among them Mike Meagher.

About one o'clock the party above named turned loose and began to. shoot indiscriminately. Talbot shot Meagher from tho rear of the bank building, killing him instantly. The citizens turned out at once with such guus as they could get hold of, and attempted to take in the party, who. in the meantime had proceeded to a livery stable in the north part of the town, compelled the man in attendance to give them horsey mounted and started off.

Speer attempted lo saddle a horse near tho Red Light dance house, and Avhix'k by sotiits one of the The others struck off in the direction of I'lunncwcll. and about two miles east struck south for the Territory! A party of citizens started after them. and at last accounts were within sight of the four fleeing cow-boys. It is LIKELY THEY WILL BR TAKEN, and if brought back alive nothing will save them from pulling hemp. The excitement here is intense, and the present disposition is to make the aiders and abettors of the murderous gang pull out from this neighborhood.

ANOTHER ACCOUNT. After filling up with bad whisky, the cow-boys attempted to run the town. Among other deviltries that suggested themselves, was to shoot as close to men on the street as they could, anil not hit the victim. The affair caused a few determined men to take a stand on a corner and tight the crowd. Mike Meagher, ex-mayor of Caldwell, was killed outright, and three of the COW-BOYS BIT THE DUST.

The cow-boys finally gave up and rode away, followed by a large posse of citizens. At last accounts, the remainder of the eang, four in number were surrounded and assistance from town was expected. STILL ANOTHER ACCOUNT. Meagher was assisting the officers hen he was shot by a Texan uauied Jim Talbot. Talbot was one of the leaders of the element that wanted to hang Danford without giving him an opportunity to settle, and was one of the leaders of the party who took Dan-ford from the sheriff at this point.

Dave Spear belonged to the Spear family of Caldwell, Kansas, who are I engsijjed in the liquor and dance house business. Dave was arrested las year chargrd with shooting and killing Frank Hunt, the marshal of Caldwell. but discharged for lack of cvislcnce, and was hardly twenty years of age.
