The State of Kansas! County of Pratt In 1 he District Court in and for Pratt county, Kansas, 20th Judicial district, April Term 180. Walter Gibbons plaintaff, vs. James Stovall, defendant. James Stovall of the Indian territory will take notice that Walter Gibbons, (if the county of Pratt and state of Kansas, did on tlie 2(ith day of December I 5 lile his petition in the district court within and for said county of Pratt, and state of Kansas, against tlie said James Stovall, defendant, setting forth that tlie said James Stovall gave a mortgage to the said Walter Gibbons on the south west quarter of section twenty live, in township twenty seven south of range twelve west, in said county of Pratt and state of Kansas, to secure the payment of $305.50, three hundred and sixty five dollars and tifty cents, according to a certain promis'ory note refered to in said mortgage. And that said James Stovall made a mistake in the writing of said mortgage and wrote the wrong number of the range in said mortgage as to wit: The mortgage should read range fifteen west, instead of range twelve west, and at tlie the time and date of the execution of said mortgage, one William Pitts was the owner of said land described in said mortgage, and that James Stovall did own the south west quarter of section twenty five, in township twentv seven south of range fifteen west, being the land intended to have been described in said mortgage, but that an error was made in the writing of said mortgage in that, and nnd that said land and premises, to wit; The south weFt quarter of section twen ty five, township twenty seven south, of range tltteen west, may le sola to pnv the same.
