The county attorney declined to allow the name of the state to he used in comneling them to do their duty. Messrs. F. H. Robb and M.

N. Bremen went to Toneka, where they obtained from Att. Gen. Bradford the right to swear out in tho name of the state a mandamus competing the county board to issue the necessary papers tor making Galva a city of the third class. The laws of the state of Kansas grant the county commissioners the authority to incorporate but not to disincorpiirate a city.

The plea that the decree had not been made because it was not recorded, is mighty thin. Such usage would repose the decreeing power in the clerk and not in the board itself. Another thing: if the principles of local which our government is professed to be based, are ot any force, the commissioners have no right whatever to deny tlie prayer of the petitioners in this case, unless it can be proven that the ietition is not genuine. If Galva wants incorporation she has a rijjht to tie incorporated, and it is no business of other people whether incorporation is best for her or not. Our county commissioners are in mighty small business, and in shielding them our county attorney is in a trifle smaller.

May, daughter of James Welch, died of scarlet fever, April 1887, agwl 15 years and 11 mouths. She was a Christian young lady, a member of the Baptist church, and her loss will be greatly felt in that society. Jimmy, the only son of James Welch, died of scarlet fever, April, iSi, 1887, aged 13 1 month and 11 days.

He was a very promising young boy. a member of the Itaptist church, and will be missed not only at home, but by many others. Belle, daughter of James Welch, died of scarlet fever, April, 28. 1887, aged 5 years and 5 months. She died in the morning and Jimmy the evening of the same day.

The father is nearly broken hearted. Stella, daughter of James Welch, died of pneumonia. May 8, 1887, aged three years and seven months. The father and two older sisters are left to mourn her loss.
