Monday V. D. Bullen raised the point that the evidence was not sufficient to convict of burglary. That the simple fact that the men were in possession of property and they were convicted of stealing does not prove or does the law allow the charge of burglary to follow as a natural sequence. Aft2i a presentation of the case on Monday by Mr.

Bullen the judge took the matter under advisement till yesterday. The court gave his decision that Mr. Bullen's position was right. As the jury had found the men guilty of burglary and larceny, it meant from 5 to 10 years for burglary and to 5 for larceny. The charge of burglary was stricken out by the judge which means a saving of that sentence to the men and reverts to the charge of grand larceny alone.
