Lord St. Vincent, lying mortaly wounded in the Soudan, and writing down in the leaf of his pocketbook a codio to his will, was exercising a privilege which has for more than nineteen centuries be longed to members of the military profession.

Julius Ciesar is always said to have been the inventor of the indulgence, whereby soldiers in activee servlc are exempted from the usual formalities attendant upon the making of a will. The privilege was extended and increased by Nerva, Trajan, and other emperors right down to the time of Justinian, who has left his mark upon the rules relating to the matter by the addition to them of two of those absurdities in which he was wont to indulge. The first is the extension of the right of informal will-making to deaf and dumb soldiers as if such men were ever likely to be employed on active service; and the other is the explanatory statement given in the institutes that this exemption wa3 accorded to soldiers "on account of their excessive ignorance." The real reason, of course, is nothing of the kind (otherwise a soldier should be allowed the same right at home a3 in the field,) but the circun-stances that in a campaign men are both more hurried and also more likely to die suddenly than in the ordinary course of life. In England wills of all sorts were long executed in a very haphazard fashion and were admitted by the episcopal courts upon evidence which we should call very irreguUr. When in the reign of Charles II, something more like a strict rule of will-making wasintroduced, a special clause was inserted in the act leaving soldiers and sailors free to dia- Eose of their personal property as they ad done befo; e.

And the same exception was allowed by the lat wills act, in favor of soldiers in "active service" and mariners or sea-men at sea. Several cases have since occurred in which wills or codicils maue in the same way as Lord St: Vincent's were contested in the courts. In 1813 Maj. Gen. Churchill died wounds in India, and his will was found to bear on it the following inscription made by a brother oflicer "Gen.

Churchill being unable to write his wishes, he bequeathes his watch to his daughter, Lady Churchill." Dr. Deane.it seems, appliad for probate of the will without this clause; but the judge refused to admit it without including the codicil thus made in "'uncupative" form. Three years later there came before the courts the first case in which a minor died hrving made a will on the field of battle. Cornet Farquhar, of the 11th, was mor tally woumiecl at the battle of Aliwal. His will was scribbled in pencil and attested only by the surgeon of the regiment; but it was admitted to probate on the application of the late Sir It.

Phil-limore. The writing of the document in pencil is, of course, no obstacle to its valididity. Indepd.a much more unusual material than black led may prob.ibly be used if convenient; as was the rule in the Roman army, where it was sullicient if a man wrote with his own blood either on piper or on the scabbard of his sword, or if he wrote with the point of his Bword in the eand. This he would really do if he happened to be alone and without writing materials; but if two witnesses weie present he might expres his wishes by mere words of mouth. The English law is much more lix in this matter than the French, which does, in- deed, allows special privileges to the military tis'ament, but still expects it to be made before two superior officers, or, if the man is wounded or ill, before the surgeon-major and commandant of police.

Avery curious peculiarity of the soldier's will in England is that, once good, it continues so lor an indefinite time. This principle was established in 1853 In Erobate of the will of an officer named esse. He had made his will while on active service in India, and had returned to this untry in IS45, about eight years before he died, and Sir Travers Twiss got the document admitted to probate. Quite a difleieut rule prevails in other countries. By the civil law a military testament was good for a yesr only after it was made, and by the Freneh code it be comes void six months after the maker of it arrives at a place where he has the op portunity ol making a will in proper form Tre pasting Bees.

Galena Gazotte. A novel suit was tried at the recent term of court in Richmond Center, before Judge Clementson. The action was brought by A. J. Powers against S.

J. Freeborn, for damages which the plantiff claimed to nave sutlered by reason ot de fendant's bees trespassing on his sheep pasture. It appears that the defendant kept large number of bee stands and the plaintiff was a sheep raiser. The latter set up in his complaint that the defendant bees, during the summer ot '85, came to plaintiff's sheep pasture in such large numbers to get honey from the clover blossoms, that they annoyed his pheeD to such an extent that thev preferred remaining in their sheds to browsing grass and clover in the pasture, and in consequence they were in such poor condition that they were unable to stand the vigorof winter and died. Judge Clementson asked the counsel if the bees Btung the sheep? No.

He said that the damage to the plaintiff's sheep was so remote that he could not entertain the claim for damages. If the sheep died from lack of food, he might have saved them by feed ing them. He therefore threw it out of court.
