Chief Engineer Dunn passed through town on Tuesday goiog west. The car3 will be running into town in 40 days, so say the officers.

Sheriff Mcintosh arrived in town Monday night with James Birks, when he had arrested in Illinois, on a charge of grand larceny. They wore accompanied by David Birks. It will be remembered this affah is the outgrowth of the Lyman-Birks-W right cattle cases of which some of our iiitizens have smarted from its effect.

James Berks was arrested on the 20th oi August, acar Mt. Pulaski, by the sheriff of Montgomery county, Kansas, tor stealing cattle from James Kennedy, of Fredonia, Wilson county, Kansas, some time in the summer of 1S76, near Caneyville, in the southwest part of Montgomery county, Kansas. lie (James Berks) operated in 1875, 187U and apart of 1877 iu Kansas, Indian Territory acd Texas. He claimed to have lost about five thousand dollars on the road from Chanute to Fredonia ia 1S7G. He also claimed to have burned ui in the Commercial Hotel at Independence, in the fall of 1876, four thousand dollars more.

He swindled John Buckles out of about He also undertook to swindle Gregory, Cooley of Chicago, out of 82.500, which he kept for nearly a year; but they had him arrested, taken to Chicago, and there a settlement was made ani he again set free, lie then went to Texa; and there bought cattle from James Johnson, shipped the animals to Chicago, but ha3 never yet paid a dollar to Mr. Davis, one of the firm who have the general contraci will locate his office in Neodesha. About next Tuesday track laying wiil be advancing this way at the rato of a mile a day. The grading is completed from the 40 mile stake, through Duck Johnsoa and Kimballs' places. Edsall Bros, are getting on finely with their work and will be through in a few days with their two miles.
