About the same evidence as in the first trial was introduced to show him insane while the defense claimed that he bad reason to be jealous of his family and that the firearms found in his room had always been kept by him and in about the same place. A large number of the neighbors from the community were brought in as witnesses and considerable disgusting testimony regarding family affairs was brought out. Next day after the case was dismissed in the probate court, Mrs. Livingstone brought suit for divorce in the district court and for a division of the property. This is generally thought to be what should have been done in the first, place.
