Reports also reached here on Saturday that Shearer had taken a relapse and was in a very critical condition. There were very few who were aware of these last reports, however, Sheriff Couch not being apprised of any change in Shearer's condition. Last night, a little after 12 o'clock, the guard on duty, Sidney King, with the prisoners, heard the tramp of horses feet, and looking out of the window saw a large troop approaching from the east, and at once notified the sheriff, in an adjoining room, of the fact.

Atkins came home last Saturday from the west where he has entered a claim, lie returned to his new possession this week, accompanied by his family. Dr. A. McAdams, county coroner, was telegraphed for and went to Anthony last Monday. On arriving there and learning the situation, he declined to oiliciate and 'Squire Blackburn held the inquest.

Blackburn, a justice of the peace of the city of Anthony, in said county, on the bodies of Philip Weaver, Oliver Weaver and Henry Weaver, these lying dead by the jurors whose names are hereunto subscribed, the said jurors, upon their oaths, do say: That the said Philip Weaver, Oliver "Weaver and I Ienry Weaver came to their deaths on the morning of the 1 Pth day of April, A. in the city of Anthony, Harper county, Kansas, by means of leaded balls, and shot, fired at and into the bodies of said Philip Weaver, Oliver Wavcr and Henry Weaver, from rifles, revolvers and shot-guns, held in the hands of persons, from the evidence adduced before this jury, unknown, supposed to be an effort to avenge the shooting of one Adelbert Sbearer- I. Olmstead. Jurors The cause of this unfortunate affair is about as follows: On the. 12 day ofd'ebruary Henry Weaver went to Danville and made himself very obnox- ATTENTION surrounded. Mr. Couch emerged from the rear of his resideuce as soon as lie could don a few garments, and attempted to get around to the school house by the back way.

He had not proceeded far when several masked horsemen appeared, and firing their revolvers, commanded him to halt. The command was obeyed. At this time he was in tiie vicinity of his stable, standing with his back to the same. He was then commanded to throw up his hands. The left hand was raised; but the right was held behind his back.

In the latter hand he held his revolver. At this juncture a masked man, with a shot gun in hand, emerged from the stable in rear, and, leveling the weapon fairly ujkjii him, commanded him to drop the revolver. This command he also obeyed, whereupon he was made a prisoner and marched off in the direction of the school building.
