A committee of the board of directors of the Alameda Grape and Wine Growing Association, from California, arrived here Wednesday evening and were met by the Kansas rneniliers, Messrs K. Q. Did yon not tell Mr. Burnicle Unit you would keep him from plowing on the land in question? Please Bnswer by yen or no. Objected to for the reason that the wit ness has already stated that he did not tell him (Burnicle) that he would not keep him from plowing, but that he would ob ject to 4iis doing any plowing on the hind. I did not Did not Mr. Burnicle ask you what you would do if he should come in at another place than the gate near the house, and commence plowing on the land in question and did you not in reply say to him that you would prevent him from plow ing or that you would leep him from plowing or words to that effect? A. Mr. Baniicle did not ask me such a question and I did not tell Baniicle or any one else that I would prevent him or any one else from plowing. Q.

Did you not know when Mr. Bar- nicle was there that it was his wish as the adininistrator of Ogden's estate, to plow or break on the land in question? Objected to for the reason that this wit ness has no means of ascertaining the wishes of Mr. Burnicle, A. I don't know that it was his wish as he had nothing with him to show he desired to do any plowing or breaking, and did not at that time know that Bar- nicle was the legally appointed administrator of the estaU) of Geo. A. I filed some claims for the burial excuses with Mr. Baruiele, but have never forced the payment from Mr. Bur nicle as I did 'uot consider him a legally appointed administrator for George W. Ogden deceased.

Q. You were willing that he should pBy your claims but not willing that he ehould administer upon the estate as to the laud in question, were you? Objected to as immaterial. A. I wan willing that Baruiele ehould pay my claim for the reason that he had taken all the old plunder that the deceased Geo. W.
