It seems to be read by the patrons of the paper with the same regularity and interest that thev exhibit in de SPECULATION Tke Smith Episode Brother Smith, of the Third ward, accuses The Times of "lying as usual," in regard to his exploits on election day. The information comes to us quite directly that at the organization of tbe returning board in the third ward, Fitzgerald, a working man of that ward, was "elected by the bystanders'" as one of the board, when Smith came to the front and claimed his prerogative as a councilman to serve as a judge of election, ousted Fitzgerald and warmed his chair for him the balance of tbe day. We do not positively know, but suspect that Smith was on to the point that this was a four dollar job, two dollars as judge of city election and two dollars as judge of county election but we do know that restless and stepped on Mr. rigbt foot, badly mashing it.

What are the merchants doing in regard to closing up their stores on tbe Fourth? Owing to the fact that it comes on Monday and so soon following the circus there will be but little business at best, and the clerks as well as proprietors will be gainers by a little rest.

We do not believe there is any law authorizing a councilman to elect himself a member of a returning board, and if there is no such law, Mr.

Smith was a usurper, and Mr. Fitzgerald is entitled to draw tbe salary. He should put in a bill and insist upon its payment.
