MAY 35, 1887. THAT UKCIHIOX. In lest week's GBAPHIO we pull-lished'the decision of the Board of Railroad Commissioners in the ease of the citizens of Elgin VM the C. K. W.

Ballroad. The decision of the Board was followed by a letter from the people's attorneys. This week we will take the liberty to review the case. In the spring of 1880 the people of Hendricks township 822,500 to the Leroy and C'ana volley Air Line upon that company agreeing to bnild a lino of road through that township to the territory line by the first day of January, 1887, and as the Santa Pe people had reason to believe that the road would not be built in accordance with the coutract thej submitted a second proposition to the township for the same amount of bonds, with the proviso that if the Air Line was built that they could not reccivo any aid from the township. As the law provides that a township can vote but a certain per cent of its valuation to railroads, and that percent III ready being vote to the Air Line the contract with the Santa Pe company was illegal and void, and in law, were not entitled to a dollar of the subsidy voted them.

Bnt through some means known only to themselves and our Board of County Commissioners the bonds thus voted were delivered to them, over (lie protest of the taxpayers of that township. The Commissioners find first that the railroad company agreed in its proposition to build a depot in Hendricks township bnt that the location was not named. In this they show that they have not even read the proposition submitted to the people, as the Santa Fedid not even agree to build as much as a side track in the township. They also find that the present location of the depot, is calculated to accomodate more people of the township than it would at old Elgin. They Qnd that only a respectable minority of the peopleare dissatisfied with the present location of the depot, and that with but little work on the wagon road that it was easily accessible from all directions.

They in rendering their decision utterly ignored the testimony of those brought before them for the citizens of Elgin and have taken the records of the post-office at the station in preference to the sworn testimony of some of the best reputed people of our county. They have not paid the least of attention to the evidence taken in the case and were appenrently so anxious to make their finding in favor of the railroad company tint they even had to resort to statements wholly unfounded and cm-phatiealy denied by the facts. While the people havo been treated very bad by the railroad company they have been treated even worse by the commissioners, who have in their finding implied that their testimony amounts to naught, and does not come far from accusing them of perjury. The facts in the caso are, the Santa Fe first stole the bonds of Hendricks township and then demanded 51-101) of all the property in and adjacent to the town of Elgin in consideration ofa depot, and when the people refused to be twice robbed they located their depot one mile west of them, and just over an impassable break in the country, and thou through in-irigue managed to havo the post ollico at the town moved to their depot. the injustice already done the people they even appropriated the name of Elgin for their new town, this was done with no other intetioo but to add additional damage to the interests of the people who reside at the eld town. In face of the fact that the Commissioners pronounced the location of the depot as being located to the best interest of the entire township, the solicitor of the road who made a personal investigation of the matter last week, pronounced the location of the depot as impractical and almost inacces-able from the south. It is our opinion that the Commissioners were either influenced in their action or are incompetent of rendering a just decision, and have their choice of accepting either the appellation of fools or knaves. The lire was discovered soon after it started but before the men could arrive on the scene the whole building was in blaze making it impossible to save anything. Fortunately there was no live stock in the barn, but the lost in oilier property was quite heavy.
