Frank McCaughlan, living on Taylor street who has been ill for several weeks and was almost recovered, died suddeuly at 7:30 o'clock last evening while eating supper. The immediate cause of death was a congestive chill. Her remains will betaken to Atchison for burial to-day. The Press congratulates the school board on having awakened to the fact that some important changes are necessary in regard to the rules and regulations governing that body. The board meets to-night to hear a report of a special committee on this subject.

Keen right on gentlemen; there is plenty ot' room for improvement iu any department of our educational system. Dr. Early attends medically to the poor of the city of Topeka, Topeka, Soldier and Menokcn townships, for $225 per year. That one man can attend to the medical wants of the poor among 80,000 people ts utter foolishness. The fact is Dr.

Early or any other man cannot do it, and as a consequence it is not done. It is better to let the "poor" take care of themselves than to have the county pay out $225 which never reaches them. State Horticultural Society. The board of trustees of the State Horticultural society met at the oflice of O. Y.

Johnson last evening. Their second au-nual fair will be hold at same time as the State fair and will be a part of it. Three thousand rive hundred copies of the report of 1881 will be printed. It contains about 500 pages and will doubtless be valuable to the fruit growers of Kansas. The contiact for printing them has been awarded to the Kansas Publishing House.

The report will not appear until next April. The premiums this year will be higher than they were last. Tho board adjourned at 9 p. m. The decision of the supreme court in the fish commission case is all the talk on the street.

Some want a call issued for a constitutional convention, others want an extra session of the legislature, some are of the opinion that disfranchising the new counties is a bad thing for Gov. St. John, some think the supreme court acted wisely, while others believe that the court was honest as it understood the case but that1 its knowledge was limited i such matter. The prohibition amendment comes in for its share of comment in connection with that decision but it is not generally thought that it will be affected. The town is pretty well "shook up" by the document and it will take some time to convince the average mind that a Kansas legislature is not infallible.

Death of Mr. Johnson Smith. A dispatch received by Mr. Allen Sells from Cleveland, brings the sad news of the death of Mr. Johnson Smith, who was well known in this city.

Mr. Smith, it will he remembered had charge of the buildings which the Sells Brothers have put up in Topeka, the most prominent of which is the Windsor home. Three weeks ago last Wednesday, Mr. Smith's daughter, Cora, a young ladjr of twenty, died at the Palace hotel in this city. Her parents went to Cleveland with her remains, and while there their only remaining child, a danghter of nine years, was taken sick and last Monday came the intelligence that she was dead, that Mr.

Smith was sick, and not likely to recover. This morning comes the terrible news of his death and that Mrs. Smith will not survive the shock. This news will cause sadness in this city where the family have mar.y friends and where they are highly respected. Mr.

Smith was about forty-three years old, a builder of large experience and a man of clear judgement. II. X. Devendorf went to Lawrence this afternoon to assist in installing officers of Wasliington t'ost, u. A. it.

B. S. Payne sued out a wirt of halmi rorout asainst Justice Dunlan and Con stablo Tomson, before Probate Judge 1 larvcy. this morning. Justice Dunlup liad served a garnishment upon t'uvne, who refused to obey the writ.

His honor proceeded against him for contempt of court and sentenced mm to Jan. Tins writ was sued out by Payne to reguin ills liberty. Judge Harvey held that it was practically imprisonment for debt, as Payne showed to tho satisfaction of the court, that if he allowed this money to go in any othcrdirection, lie would be held upon the note, the payment of which was dependent upon the money in tpies tion. The board of county commissioners were in session this forenoon and besides attending to some routine business, the contract for coffins for paupers were awarded to Mr. Stoker.

T. J. Kelhim were awurded the contract for stationary. Ed. Sipes was appointed superintendent of the poor asylum.

George Cofliuberry, sentenced to the county juil for assault and battery, was discharged. The black mailing case, wherein Lewis N. Barnes is defendant and John P. Cole as plaintiff, came up in Justice Reed's court at four o'clock this afternoon. All parties, however, did not get down to business until it was too late for publication of the proceedings in to-day's paper.

It was contiuued until to-morrow at 10 o'clock. Business in the justice courts at this time of tne year seems to be exceedingly dull. The merry-making and general good humor during the holidays seem to have cleared away the acerbities of human nature for a time, and legal squabbles are not so plentiful. Topeka womankind which has been kept indoors by the recent cold weather, is out in force this afternoon, enjoying the sunshine in a small degree, and the pleasures of shopping combined with gossip and Btaring at toilets, in a very great degree. A meeting of the Equitable Aid Union, is to be held at the music rooms of Geo.

W. Arbuckle this evening, at 7:30 o'clock, for the purpose of explaining the objects of the order and receiving new members. All who are interested aro cordially invited. The case of Ilentig vs. Kansas Loan and Trust company, in the district court, still continues to occupy the attention of Judge Morton.

The suit is for the sum of $10,000 for services rendered. The black marble mantels for the west wing of the state house have arrived and been unpacked. The elegant' eugrayed marble tops for the heaters are also here and other marble works of various kinds. A lively runaway took place on Kansas avenue about five o'clock yesterday after noon. We have several every day or late.
